Terms of Service
1. Acceptance
By accessing or using the AutoFri website (autofri.com), the AutoFri mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. AutoFri is a registered trademark of Autofri Africa Ltd., a company registered in Nigeria, which operates this platform and the Auto AFrica mobile application. References to "AutoFri", "we" or "us" in these terms mean Autofri Africa Ltd.
2. The Service
AutoFri operates a cross-border used-car trading platform that connects Chinese wholesalers with African dealers. The Service includes inventory browsing, live video viewing requests, order placement, payment coordination, shipping and tracking. AutoFri acts as the contractual counterparty for every transaction.
3. Eligibility
You must be at least 18 years old and authorised to conduct business in your jurisdiction to place an order. Commercial buyers must provide valid registration documents on request.
4. Orders and payment
All prices are quoted in U.S. Dollars. Payment is made by bank transfer in two tranches — a deposit on order confirmation and a balance on arrival at the destination port. Card payments are not supported. Payment receipts must be uploaded inside the AutoFri app and are subject to verification by our operations team.
5. VIN lock and substitution
The Vehicle Identification Number (VIN) listed at the time of order is the unit you will receive. If the delivered unit materially differs from the listing (VIN, mileage, year, undisclosed major damage), AutoFri will refund the deposit or replace the unit at AutoFri's cost. Resolution is handled by a human operator.
6. Shipping, customs and risk of loss
Shipping terms (FOB or CIF) are specified in the order. Title and risk transfer in accordance with the agreed Incoterm. Where AutoFri offers bundled customs clearance at the destination port, additional fees and conditions apply and are disclosed at order time.
7. Acceptable use
You agree not to (a) circumvent our payment or order flow, (b) attempt to contact upstream wholesalers directly, (c) misuse the Service for fraud, money-laundering or sanctions evasion, or (d) probe, scan or attack the Service's infrastructure.
8. Limitation of liability
To the maximum extent permitted by applicable law, AutoFri's aggregate liability arising out of or in connection with any order is limited to the amounts actually paid by you for that order. AutoFri is not liable for indirect, consequential, incidental or punitive damages.
9. Force majeure
AutoFri is not liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, war, port closures, sanctions, pandemics, carrier failures or government action.
10. Changes
We may update these Terms from time to time. Material changes will be highlighted on the website. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China. Any dispute will first be addressed in good-faith negotiation, and failing that, by arbitration in Shenzhen under rules to be specified in the final version of these Terms.
